On Thursday, August 14, the Central District Court in Warsaw dismissed the prosecution of Zbigniew Komosa against Jarosław Kaczyński over allegations of bodily harm. The case focused on an incident during a Smoleńsk memorial where Komosa claims the PIS leader struck him twice in the face.
Judge’s Statement: “You cannot praise, yet on the other hand…”
Judge Łukasz Grylewicz noted that while such conduct cannot be praised, the court deemed the social harm negligible due to special circumstances, thus the act does not constitute a crime. The judgment is not final; Komosa plans to appeal.
Background of the Komosa‑Kaczyński Dispute
The dispute originates from allegations of assault during a Smoleńsk remembrance in October 2024. Since December 2023, Komosa has placed wreaths by the Smoleńsk monument with inscriptions criticizing Lech Kaczyński for the crash. He has sought a settlement, demanding an apology for alleged false claims about the Smoleńsk incident.
