Polish Justice Minister and Prosecutor General Waldemar Żurek has submitted a request to the Constitutional Court to hold Judge Bogdan Święczkowski accountable.
Prosecutor General’s Request
Waldemar Żurek, the Minister of Justice and Prosecutor General, has filed a motion with the Constitutional Court seeking to hold Judge Bogdan Święczkowski criminally liable. The case is linked to the use of the Pegasus spyware to monitor Roman Giertych.
The prosecution has determined that Bogdan Święczkowski exceeded his authority.
Prosecutor’s Statement
Anna Adamiak, spokesperson for the Prosecutor General’s Office, announced the decision on Tuesday, September 30. She stated that the evidence collected so far provides sufficient grounds to suspect that Bogdan Święczkowski, while serving as the National Prosecutor from June 2020 to July 2021, overstepped his authority.
Allegations Against Święczkowski
Adamiak explained that the proceedings concern Święczkowski’s instructions to Prosecutor Paweł Wilkoszewski to conduct an unauthorized review of operational activities carried out by the Central Anti-Corruption Bureau (CBA) against Roman Giertych.
She added that Święczkowski was aware that some of the materials obtained from the CBA included information protected by attorney-client privilege, which is subject to absolute and relative evidentiary prohibitions.
Motion to Lift Immunity of Małgorzata Manowska
Przemysław Nowak, spokesperson for the National Prosecutor’s Office, announced on Tuesday that a motion to lift the immunity of Małgorzata Manowska, President of the State Tribunal and First President of the Supreme Court, has been resubmitted to the State Tribunal.
The prosecution had previously filed a motion to lift Manowska’s immunity on July 16, alleging that she exceeded her authority and failed to fulfill her duties while leading the State Tribunal and the Supreme Court.
