Poland’s Justice Minister and Prosecutor General Waldemar Żurek filed a constitutional court request against judge Bogdan Świeczkowski over alleged misuse of Pegasus spyware.
Request Filed Over Pegasus Spyware Use
Justice Minister and Prosecutor General Waldemar Żurek submitted a request to the Constitutional Tribunal regarding the criminal liability of judge Bogdan Świeczkowski. The case concerns the use of Pegasus spyware to monitor Roman Giertych.
The prosecution found that Bogdan Świeczkowski exceeded his authority.
Prosecutor’s Statement
Prosecutor General spokesperson Anna Adamiak announced the decision on Tuesday, September 30. She stated that the collected evidence sufficiently justifies suspicion that Bogdan Świeczkowski, as a public official and acting as the National Prosecutor from June 2020 to July 2021, exceeded his authority.
Allegations of Unauthorized Surveillance
Roman Giertych was allegedly monitored using Pegasus. The prosecutor stated that Świeczkowski ordered oversight without proper authorization.
Adamiak clarified that Świeczkowski, as National Prosecutor, instructed prosecutor Paweł Wilkoszewski to conduct an unauthorized review of operational-intelligence activities against Giertych. She noted that Świeczkowski was aware that some materials obtained from the Central Anti-Corruption Bureau included information protected by attorney-client privilege, which is subject to absolute and relative evidentiary prohibitions.
Immunity Request for Małgorzata Manowska
Prosecutor General spokesperson Przemysław Nowak announced that the State Tribunal received another request to lift the immunity of Małgorzata Manowska, President of the State Tribunal and First President of the Supreme Court. The prosecution previously requested the lifting of Manowska’s immunity on July 16, alleging she exceeded her authority and failed to fulfill her duties in overseeing the State Tribunal and Supreme Court.
