Prosecutor Dariusz Korneluk expressed shock at comments by Prosecutor Ewa Wrzosek regarding the ongoing two‑tower investigation linked to PiS leaders, noting that evidence could lead to lifting immunity.
Prosecutor Ewa Wrzosek on the Two‑Tower Case
Until June of this year, Prosecutor Ewa Wrzosek led the investigation into the so‑called “Two Towers”. Her assignment at the Regional Prosecutor’s Office ended, and she returned to the Warsaw‑Mokotów District Prosecutor’s Office. The investigation was then taken over by Deputy Regional Prosecutor Małgorzata Szeroczyńska. In a September interview with TOKFM, Wrzosek said that, to her judgment, the investigation should have advanced to a substantive decision, but that was beyond her jurisdiction. She added that a new reference prosecutor now oversees the case and that she does not exclude the possibility of charges being heard against PiS leader Jarosław Kaczyński.
National Prosecutor Korneluk’s Surprise
On Monday, national prosecutor Dariusz Korneluk reacted to Wrzosek’s remarks on TOKFM. “I was very surprised to hear the prosecutor’s statement,” he said. “There is a new reference prosecutor for this case, and I know the procedures are planned. If evidence justifies a request to lift immunity, such a decision will be made,” he clarified.
Srebrna Company and the Proposed Twin Towers
The two‑tower case revolves around the company Srebrna, managed by individuals from the PiS political sphere. The current CEO is Tomasz Bartczak, a former financial agent for PiS election committees. The sole shareholder of Srebrna is the Lech Kaczyński Institute Foundation, whose board includes PiS leader Jarosław Kaczyński. The company sought to build two twin towers forming one office complex, with a 190‑metre structure slated for a plot in central Warsaw.
Investigation Timeline
In January 2019, Gazeta Wyborcza published recordings of conversations between Jarosław Kaczyński and Austrian architect Gerald Birgfellner, who had worked on the building’s design between 2017 and 2018. The architect claimed he performed the work and demanded 1.3 million euros, a sum that Srebrna refused to pay. In the same month, Birgfellner’s representatives notified the prosecutor’s office of a “well‑grounded suspicion of a crime by Jarosław Kaczyński,” accusing the PiS leader of “grand scale fraud.” The prosecutor’s office declined to open an investigation, and the court approved that decision. The investigation was only launched in February 2025 by Prosecutor Ewa Wrzosek.
Kaczyński Rebuts Birgfellner’s Claims
In February 2019, Kaczyński told the Polish Press Agency that the architect’s requests were based on undocumented work. “He demanded payment for work that had no documentation whatsoever,” he said. “My request to the supervisory board and the company’s management was to force them to pay illegally, which I neither wanted nor could do. None of these bodies would comply with such demands,” he added. Kaczyński further noted that he could only verify the claims based on invoices and execution documents, none of which existed for the architect’s work.
