Agent Tomek Wins Court Case, Says ‘I Have No Grounds for Happiness’

Former CBA officer Tomasz Kaczmarek, known as Agent Tomek, won a court ruling in Lublin on September 16, removing police surveillance and a bond imposed over alleged false testimony.

Court Ruling Removes Security Measures

The Lublin District Court affirmed Kaczmarek’s request to lift the security measures that had been imposed in connection with the ongoing investigation into false statements. The court determined that the restrictions were unjustified and therefore ordered their termination.

Background: Agent Tomek and the CBA

Kaczmarek, who served as a law‑enforcement officer for the Central Anti‑Corruption Bureau (CBA), had previously faced a provisional detention order and a monetary bond related to the case. He stated that he was still compelled to testify at various prosecutors’ offices about alleged abuses within the CBA, yet nothing has progressed in his own matter.

Operation SILVER and Property Investigation

In 2008, the CBA launched ‘Operation SILVER’ to expose alleged criminal activity of Aleksandra and Jolanta Kwaśniewska. Kaczmarek operated undercover as a real‑estate agent under the alias Tomasz Małecki. He obtained a luxury vehicle, expensive watches and large amounts of cash to bolster the ruse. The target was a villa in Kazimierz Dolny reportedly owned by the Kwaśniewskis, but the operation failed to prove ownership.

Kaczmarek’s Testimony Against Kamiński and Wąsik

In 2019, when the probe was renewed, Kaczmarek testified that CBA directors Mariusz Kamiński and Maciej Wąsik had pressured him to falsify confidential notes to justify the operation. He accused them of manufacturing evidence to secure court approval for wiretaps. The directors later filed a complaint against him, claiming he had provided false testimony. Consequently, he faced police supervision and a bond.

Although the case against the Kwaśniewskis was dismissed after PiS lost power, the investigation was taken over by the Lublin prosecutor’s office and continues. Kaczmarek’s recent court victory allows him to proceed further, but the matter remains under active scrutiny.
