Rosati Accuses Polish State of Weakness in Bąkiewicz Case; Authorities Could Have Collected Evidence Faster

Polish prosecutor opens investigation into Rosati’s criticism of state after remarks on Bąkiewicz case, sparking debate over police and court response times.

At a PiS‑organized rally in Warsaw on 11 October, Bąkiewicz urged citizens not to fear intimidation, called for justice, and declared that the “weeds” must be uprooted from Polish land, even if it means burning the soil to prevent regrowth, and that people should wield a sword and a rosary simultaneously.

Investigation Initiated

The Warsaw District Prosecutor’s Office announced on Monday that it had taken action on Bąkiewicz’s remarks, registered the case with the prosecutor, and forwarded it to the Capital Police Command for an investigation under Article 255 § 2 of the Criminal Code, which provides for up to three years’ imprisonment for public incitement to commit a crime.

Evidence Could Have Been Collected Faster

Rosati, president of the Polish Bar Association, said eight days had elapsed since the investigation began and no charges had been filed, criticizing the prosecutorate’s delay and asserting that evidence could have been gathered earlier.

This Is a Weakness of the State

Rosati reminded viewers of a 2024 incident involving MP Grzegorz Braun, noting the Polish state’s inadequate response, insisting that Bąkiewicz lacks immunity, and labeled the situation as a weakness of the state.
