Historic Court Decision on 8-Year-Old Kamil’s Death, But Questions Remain

On Thursday (January 15), the District Court in Kielce decided that investigators will once again examine the case of institutional responsibility for the death of Kamil from Częstochowa. This concerns the actions of courts, prosecutors, police, and social workers in the case.

Magdalena Mazurek, Kamil’s stepsister, told Wirtualna Polska, “It’s hard for me to say anything because of emotions. I feel like crying with joy. It seems to me that all this is a dream. I am very happy that the court approached the case so seriously and that it will be further investigated. I believe that all this will go in the right direction and that thanks to this case the entire system will improve.”

Children’s Ombudsman Calls Decision Historic

Children’s Ombudsman Monika Horna-Cieślak emphasized that the court’s decision is “historic” and “restores the sense of dignity of children who died as a result of experiencing violence, even though there were adults around them.”

“It shows that each of us, and especially institutions, is obliged to react to violence against children. The case of little Kamil is fundamental in terms of child protection. It shows what can happen when we do not react. A child can be tortured and die before the eyes of all of Poland. I want to live in a country where children are safe,” Horna-Cieślak stated.

Legal Status and Future Steps

The court ruling does not concern the actions of doctors and teachers – in this area the case is legally final. However, the Children’s Ombudsman noted doubts about the decision regarding teachers.

“In this area, Kamil’s sister will probably file a complaint with the European Court of Human Rights. I will support this complaint,” the Ombudsman said. She also added that the case of Kamil from Częstochowa should be declassified for its educational value in showing how to properly protect children.

Background of the Case

8-year-old Kamil died under circumstances that allegedly involved being burned and scalded with boiling water, raising questions about why authorities didn’t intervene despite clear signs of abuse.
