Historic Court Decision in 8-Year-Old Kamil Death Case, But Questions Remain

Kielce court orders reinvestigation into institutional responsibility for death of 8-year-old Częstochowa boy allegedly abused with boiling water.

Court Orders New Investigation

On Thursday, January 15th, the District Court in Kielce decided that investigators will again examine the case of institutional responsibility for Kamil’s death from Częstochowa. The case concerns the actions of courts, prosecutor’s office, police, and social workers.

Emotional Response from Family

“It’s hard for me to say anything because of emotions. I feel like crying with joy. It seems like all this is a dream. I’m very glad that the court approached the case so thoroughly and that it will be further investigated,” said Magdalena Mazurek, Kamil’s stepsister, to Wirtualna Polska.

Ombudsman Calls Decision “Historical”

The Ombudsman for Children emphasized that the decision is “historical” and “restores the sense of dignity for children who died as a result of experiencing violence, even though adults were around them.”

“It shows that institutions are obliged to react to violence against children. Kamil’s case is fundamental in child protection. It shows what can happen when we don’t react,” stated Monika Horna-Cieślak.

Exclusions and Future Steps

The court ruling does not concern doctors and teachers – in this area the case is finally concluded. “We have doubts about the decision regarding teachers. Kamil’s sister will probably file a complaint with the European Court of Human Rights,” noted the Ombudsman for Children.

She also added that the case should be declassified for educational purposes to show what should be done to properly protect children.

Allegations of Abuse

The 8-year-old Kamil was allegedly burned and scalded with boiling water.
