Lawyer Lesicka: Court Rejected Lawsuit Not Due to AI Use

The Wrocław District Court dismissed a compensation lawsuit on November 27, 2025 (case no. X GC 455/25) because the plaintiff failed to meet the formal requirements of the inquiry. In its justification, the court also referenced the use of AI in the case. Some commentators have interpreted this as the court challenging the right of parties to use such tools.

Defense Counsel’s Perspective

According to Joanna Lesicka, the defendant’s counsel, the case has generated strong emotions among lawyers on social media due to oversimplification of its message. “This ruling is not against technology, but against carelessness and lack of critical thinking,” Lesicka stated. She noted that both business and legal fields have become infatuated with the ease of content generation, forgetting that AI is a powerful engine that will derail at the first turn without a driver.

AI Documentation Issues

In this case, there was a lack of human factors and critical verification that a living lawyer would perform, Lesicka emphasized. The court determined that attachments to the lawsuit, including arguments, legal analysis, and assessment of chances of winning the process generated by Chat GPT, do not constitute evidence.
