President of the Constitutional Tribunal files report on Polish government to US authorities

Polish Constitutional Tribunal president Bogdan Święczkowski sent a 100‑page report to U.S. officials, accusing the Polish government and the European Union of undermining the Tribunal and calling for a restoration of the rule of law.

Report Sent to the United States

Just a week after Poland’s presidential election results were announced, on June 9, 2024, Bogdan Święczkowski, president of the Polish Constitutional Tribunal, sent a nearly 100‑page report to U.S. authorities outlining the state of rule of law in Poland.

Recipients of the Report

The document was addressed to former U.S. Supreme Court Chief Justice John G. Roberts and U.S. Attorney General Pam Bondi.

Contents of the Report

Święczkowski criticized the Polish government and the European Union for what he described as targeted attacks against the Constitutional Tribunal, noting that “the Tribunal is currently facing unprecedented assaults by the majority in parliament and the government.”

He also highlighted the Tribunal’s lack of published decisions, the freezing of judges’ salaries, and the failure to fill vacant positions.

“The undermining of judicial independence and the unprecedented attacks on institutions designed to protect the rights and freedoms of citizens must not go unnoticed,” Święczkowski warned.

Tribunal as a Bastion of Sovereignty

He stressed that the Tribunal is “one of the last bastions of Poland’s sovereignty,” making it a target for both the government and international organisations.

Since December 13, 2023, the ruling majority has repeatedly issued statements aimed at denigrating the Tribunal and its judges, labeling them “cheaters” and “poseurs in judicial robes.”

Recent Parliamentary Actions

In March 2024, the Sejm adopted a resolution to “eliminate the effects of the constitutional crisis of 2015‑2023 in relation to the Tribunal’s activity,” effectively invalidating the 2015 Unity of Right majority’s annulment of the proper selection of three Tribunal judges at the end of the PO‑PSL coalition’s governance.

President Andrzej Duda did not accept the oaths of the recalled judges, while the Tribunal itself ruled that the selection of those judges had been conducted properly.
