Polish Ministry of Finance confirms KSeF system will not allow reporting of fraudulent invoices as initially planned for February 2026.
KSeF Implementation Delay
The Polish Ministry of Finance had assured the public that the KSeF system would launch on February 1, 2026. However, this deadline was not met. Zbigniew Stawicki, deputy head of the National Tax Administration, informed on February 4, 2026, in response to parliamentary inquiry no. 14585, that KSeF will only enable reporting of fraudulent invoices in the future. He did not provide a specific date.
Concerns for Businesses
Businesses have long expressed concerns that when mandatory KSeF comes into effect, unethical entities will begin mass-invoicing on behalf of other companies, thereby paralyzing accounting departments.
Public Institutions Targeted
Doubts in this area intensified in January 2026, when an opposition politician suggested online that public institutions could become victims of such practices. Recently, the politician found an imitator. A video was posted online showing a person buying condoms at a pharmacy requesting a KSeF invoice on behalf of the Chancellery of the Prime Minister. The video’s creator claimed his idea demonstrated a systemic loophole.
Previous Vulnerability
Even before mandatory KSeF was implemented, it was possible to issue invoices under another company’s name, but such invoices did not reach the accounting systems of VAT taxpayers. Now, with the central system in operation, any business could fall victim to such a scam.
