Key Civil Procedure Code Amendment Approaches Implementation
The deadline for the entry into force of key provisions of the amendment to the Code of Civil Procedure (k.p.c.) of August 5, 2025 is approaching.
One of the most controversial changes is the imposition on commercial courts of the obligation to direct parties to mediation in cases concerning construction contracts and contracts closely related to the construction process.
Courts Must Direct Parties to Mediation
Under Art. 458³ª k.p.c., added from the beginning of March of this year, the court must do this obligatorily before the preparatory hearing or before the first hearing set for trial.
Purpose of New Regulation: Reducing Court Burden
The purpose of the new regulation is to reduce the burden on commercial courts.
