Between March and May 2024, the individual received the following benefits: a food/grocery allowance (March & May), partial coverage for medication and treatment (March), rent assistance (March), clothing allowance (April), and footwear allowance (April). Further benefits were received throughout 2023 and 2024, beyond those specifically cited in the court ruling.

Legal Dispute Over Benefit Amount

The individual did not challenge the *receipt* of benefits, but rather the *amount* awarded. They appealed a 200 złoty food allowance, seeking 1000 złoty, citing ongoing health and financial hardship. The case is still under review by the court.

The benefits were granted under Article 39 of Poland’s Social Assistance Act, which allows for assistance to meet essential living needs, including food, medicine, clothing, and housing costs. The law provides for an open-ended catalog of eligible expenses.

According to a 2014 ruling by the Voivodeship Administrative Court in Gorzów Wielkopolski, an “essential need” is one without which an individual cannot exist or maintain a basic, dignified standard of living.

MOPS Budget Limitations and Restrictions

Despite the possibility of multiple benefits, MOPS and other social assistance centres are subject to budgetary constraints. The Supreme Administrative Court recently affirmed their right to limit benefits based on available funds, balancing the needs of all applicants.
