Unintended Consequences of Legal Revisions
Intended to resolve long-standing disputes over floor area calculations, the new regulations have introduced fresh complexity. Legal and real estate experts warn that the amendment could expand the definition of usable area to include elements previously excluded, potentially inflating both property prices and owner maintenance costs.
The core objective of the legislation was to standardize how floor space is presented in sales offers and to stop the common practice of including partition walls in the usable area. However, the reliance on a specific Polish standard instead of the previous ministerial decree has created significant interpretive gaps.
Debate Over Balconies and Staircases
The shift in legal references now potentially allows for balconies, terraces, loggias, and internal staircases to be included in the total square footage. This has raised concerns among buyers that the usable area of apartments may be artificially inflated to mask actual living space limitations.
