A sweeping reform of spatial planning in Poland is set to phase out indefinite zoning decisions, granting municipalities greater control over residential development while imposing stricter requirements on future construction projects.
The Shift Away from Current Zoning Practices
A significant revolution in spatial planning is underway. Municipalities are gaining greater authority over where housing developments can be built, meaning the popular “Warunki Zabudowy” (WZ) zoning decisions will no longer be granted automatically.
Obtaining these decisions will soon become much more difficult. The reform, intended to curb urban sprawl and organize construction, has already begun to impact the ability to build single-family homes.
Extended Deadlines for General Planning
A legislative amendment passed in late April provides investors with more time to adapt. The government has extended the deadline for municipalities to enact general plans until the end of August 2026, following requests from local officials who warned they could not meet the original timeframe.
The primary goal is replacing existing land-use studies with new general plans. These plans will dictate the direction of municipal development and specify areas where zoning decisions may be issued.
Surge in Applications Before New Rules
Municipalities are relieved by the extension, largely due to the high costs of preparing new planning documents, which are estimated to reach up to 300,000 PLN per document with a process spanning 20 months. Consequently, many municipalities are reporting a surge in WZ applications as investors scramble to secure building rights under current regulations.
Investors must remember that the date of effectively initiating the procedure and submitting a complete application to the office is crucial for securing these rights.
New Expiration Dates and Requirements
One of the most critical changes is that WZ decisions will now be valid for only five years, ending the era of indefinite permits. Only those that became final before the end of 2025 will retain their indefinite status.
Starting in 2027, only individuals holding a legal title to the property for construction purposes will be eligible to apply for a zoning decision. This policy aims to make spatial planning more transparent and discourage land speculation.
