Contractors must formally agree to extend public procurement deadlines within the specified timeframe, even if it falls on a Sunday.
Legal Framework for Offer Binding
According to Article 307(1) of the Public Procurement Law (p.z.p.), the contractor is bound by their offer until the expiration of the deadline specified in the tender documents. If the selection of the most advantageous offer does not occur before this deadline expires, the contracting authority may once again request contractors to consent to its extension for a period not exceeding 30 days.
Requirements for Extension Agreement
Contractors must submit a written declaration expressing their consent to this extension. If a security deposit (wadium) is required, it is essential to either extend its validity or submit a new one for the extended period.
