Polish allotment gardens (ROD) are intended for recreation and relaxation, but specific rules govern their use. Violating these regulations can lead to the loss of the right to lease the plot.

Many myths surround allotment garden usage, particularly concerning overnight stays, gatherings, and commercial activities. However, clear rules are outlined in ROD regulations and bylaws.

Overnight Stays and Residency

Polish law explicitly prohibits residing permanently on allotment garden plots. “Residency” is defined as using the plot as a primary residence, receiving mail there, and spending the majority of the year on the property.

Recreational overnight stays or longer visits, such as during vacations, are permitted, provided the user maintains a separate permanent address.

Commercial Activity

Operating a business on allotment garden grounds is strictly prohibited by law. This includes hosting paid events, such as children’s birthday parties.

Allotment plots are intended solely for recreational use by the plot holder and their family. Renting or even allowing free use of the plot to third parties is also forbidden and can result in lease termination.

Consequences of Violations

Violating the rules regarding residency or commercial activity constitutes a breach of ROD regulations and the law, potentially leading to the loss of the lease.

Owners also risk losing their lease and any compensation for structures if they build structures exceeding the permitted 35 square meter limit.

Fires and Grills

The permissibility of bonfires or grills on an allotment plot depends on the type of fire and specific local regulations. It is essential to check the ROD regulations and association statutes for detailed rules regarding open flames.

Using the plot in a way that does not disturb neighbors is also a general rule, consistent with its recreational nature.

Penalties for Excessive Structures

Severe legal and financial penalties apply to possessing structures on an allotment plot exceeding the allowed 35 square meter footprint.

Permitted Activities

Allotment plots are primarily for recreational purposes. Overnight stays are allowed as long as they do not become permanent residency, while commercial activity and renting the plot are entirely prohibited. Social gatherings, such as barbecues, are permitted as long as they do not disturb others.

Adhering to building regulations is also crucial, as exceeding the allowable structure size can lead to serious financial and legal consequences.
