Amendment: Sickness Benefit Period Must Be Calculated Uniformly by All Payers

Poland amends law to standardize calculation of sickness benefit periods across all payers.

Sickness Benefit Period Definition

The sickness benefit period is, in simplified terms, the maximum time during which an employee can receive both sick pay and sickness benefits combined. For other insured individuals, this limit applies exclusively to sickness benefits and is established according to the rules specified in Articles 8-9 of the Act on Monetary Benefits from Social Insurance in Case of Illness and Maternity.

Duration of Sickness Benefits

According to Article 8, paragraph 1 of the Sickness Benefits Act, sickness benefits are granted for the period of inability to work due to illness or inability to perform work for specified reasons, but not longer than 182 days. If the inability to work was caused by tuberculosis or occurs during pregnancy, the period is not longer than 270 days.
