Benefit Recipients Must Return Improperly Received Payments With Interest

Persons who received benefits they weren’t entitled to must return those payments along with accrued interest, according to Polish social insurance law.

Legal Basis

This results from Art. 84 par. 1 of the Act on the social insurance system (hereinafter: u.s.u.s.).

Types of Benefits Subject to Return

Pursuant to Art. 84 par. 2 point 3 u.s.u.s., amounts of incorrectly received benefits include benefits due to inability to work caused by illness from health or accident insurance.

Circumstances Triggering Repayment Obligation

For such benefits, repayment is required when it has been established that during the period of receiving the benefit, the beneficiary performed paid work during the period of certified inability to work or used the work leave in a manner inconsistent with the purpose of this leave.
