Poland’s Chief Labour Inspector will no longer issue legal interpretations during workplace inspections under new draft legislation.
New Prohibition During Inspections
The latest version of the amendment to the Labour Inspection Act prohibits the Chief Labour Inspector from issuing individual interpretations during ongoing inspections. This restriction is designed to maintain inspection integrity.
Authority to Issue Interpretations
The draft legislation grants the Chief Labour Inspector the right to issue individual interpretations regarding the application of labor law provisions. Specifically, this concerns determining whether a legal relationship presented in a request constitutes an employment contract under Article 22 § 1 of the Labour Code.
Additional Ministry Feedback
In addition to the ban on issuing interpretations during inspections, the Ministry of Labor has incorporated other comments submitted by the Ministry of Finance into the legislation.
Document Submission for Interpretations
The amendment will explicitly allow the attachment of documents to requests for interpretations. This includes contracts and other materials that better illustrate the actual nature of the working relationship being examined.
