Justice Minister Waldemar Żurek called on President Karol Nawrocki to promptly invite the remaining candidates to the Constitutional Tribunal, warning of a constitutional breach.
Minister Żurek Asserts Valid Tribunal Appointments
Justice Minister Waldemar Żurek stated on Wednesday that all six judges selected by the Sejm for the Constitutional Tribunal were properly chosen. He appealed to the President to immediately invite the remaining four candidates, enabling the Tribunal’s proper functioning.
Żurek emphasized that a failure to act would, in his view, constitute a clear violation of the constitution.
Presidential Inauguration of Two Judges
During a press conference, the head of the Chancellery of the Sejm (KPRP) reported that President Karol Nawrocki administered oaths to two individuals elected by the Sejm on March 13th as Constitutional Tribunal judges: Dariusz Szostek and Magdalena Bentkowska.
The Kancelaria Prezydenta (Presidential Chancellery) is currently reviewing the cases of the remaining four candidates, with no decision yet made.
Appeal for Swift Action to Avoid Constitutional Crisis
“The President cannot choose according to his own discretion whom he wants to include in the Constitutional Tribunal. I therefore appeal to the President to invite the remaining four as soon as possible – so that the Constitutional Tribunal can function properly. Otherwise, it will be an obvious violation of the constitution,” Żurek told journalists on Wednesday afternoon.
Threat of Formal Objection
Żurek indicated that if the invitation to the Presidential Chancellery is not extended, a formal statement will be made against the President, presented in a manner acceptable to the legal community.
“We will not remain helpless, because the state cannot abdicate,” the Minister of Justice stressed.
Remaining Candidates Awaiting Decision
In addition to Szostek and Bentkowska, the Sejm elected Krystian Markiewicz, Maciej Taborowski, Marcin Dziurda, and Anna Korwin-Piotrowska as Constitutional Tribunal judges in March.
