Bogdan Święczkowski, President of Poland’s Constitutional Tribunal, has formally invited Magdalena Bentkowska and Dariusz Szostek to begin their service.
Invitation to New Judges
Bogdan Święczkowski sent invitations to Magdalena Bentkowska and Dariusz Szostek, who took their oaths of office before President Karol Nawrocki on April 1st.
The invitation requests they fulfill their obligation to commence their duties at the Constitutional Tribunal, according to a statement by the Tribunal’s spokesperson, Weronika Ścibor, to TVN24.
Constitutional Basis for Service
Ścibor referenced Article 195, paragraph 2 of the Constitution, stating that Święczkowski will “ensure working conditions” for the newly sworn-in judges and assign them cases.
She added that Święczkowski expects the judges to promptly address important matters for citizens.
Legal Framework for Appointment
The Tribunal’s spokesperson also reminded that, according to Article 5 of the Act on the Status of Constitutional Tribunal Judges, a judge’s employment relationship begins after taking the oath before the President of the Republic of Poland.
Exclusion of Other Appointees
The other judges selected by the Sejm were not invited to the Presidential Palace for their swearing-in ceremony on April 1st.
