Court Rejects Defense Motions in Profeto Foundation Case

Warsaw District Court rejects defense motions in case involving improper transfer of 66 million PLN to Profeto Foundation despite unmet requirements.

First Hearing on Indictment in District Court

On Wednesday, the first hearing was held at the Warsaw District Court regarding the indictment against six people, including Fr. Michał Olszewski and former officials of the Ministry of Justice.

The case concerns irregularities related to the transfer of over 66 million PLN to the Profeto Foundation from the Justice Fund, despite the foundation not meeting formal and substantive requirements.

Defense Motions Rejected

During the approximately six-hour hearing, the defendants’ lawyers presented numerous formal motions, including requests to dismiss the court proceedings, suspend them, and postpone them.

The presiding judge, Justyna Koska-Janusz, who did not agree to most of the defense’s motions, closed the hearing to the public at the end.

The reason was a motion regarding Fr. Olszewski, in whose case psychiatrists diagnosed him with advanced post-traumatic stress disorder.

Next Court Hearing and Process

On January 28, the court will continue proceedings. The indictment hasn’t been read yet, and further formal motions may be filed.

One of the defendants’ attorneys, Adam Gomoła, stated they will consider their next steps after leaving the courtroom.

Background of the Case

The case concerns the first indictment in an investigation into abuses related to the Justice Fund, which was transferred to the Warsaw District Court in February 2025.

The charges against the defendants – Fr. Olszewski and former MS officials Urszula D. and Karolina Ś. (formerly Karolina K.) – include participation in an organized criminal group.
