Poland’s implementation of the EU Data Act faces significant concerns, particularly regarding its impact on administrative courts.

The bill prepared by the Ministry of Digital Affairs on fair access to and use of data is set to implement the EU’s Data Act into Polish law. This regulation governs, among other things, the rules for sharing and using data generated by internet-connected devices, such as cars, industrial machinery, or smart home equipment.

Thanks to the Data Act, ordinary users of such devices have gained the right to access detailed data generated by them. This includes, for example, information on how a driver operates a car or data on home heating systems.

EU regulations also protect business interests. Under the new provisions, the procedure for transferring data stored in digital archives, so-called clouds, between operators is intended to be cheaper and simpler.

Impact on Polish Administrative Courts

The implementation of the EU Data Act in Poland is expected to have significant implications for the country’s administrative courts, potentially increasing their workload and creating new legal challenges.
