New Pay Transparency Law
In December 2025, a draft law titled “on strengthening the application of the right to equal pay for men and women for equal work or work of equal value” was published. It is provisionally named the pay transparency law and is considered highly important.
Criminal Provisions Raise Concerns
The author expresses concerns about whether the draft has been adequately considered, focusing specifically on the proposed criminal provisions in Article 54 point 2.
Changes to Labor Code Proposed
The draft proposes amending Article 281 of the Labor Code, creating a new norm stating: “Whoever, being an employer or acting on their behalf, obtains personal data other than those specified in Article 22(1) § 1 and § 2, shall be subject to a fine of 1,000 to 30,000 PLN.”
