A 26-year-old driver struck a 6-year-old boy on a sidewalk in Sierakowice on May 27, with police stating that blinding sun glare likely contributed to the accident.
The Incident in Sierakowice
On Wednesday, May 27, a traffic accident occurred in Sierakowice, Pomeranian Voivodeship. A 6-year-old boy walking with his father on the sidewalk along Kartuska Street was struck by a Kia passenger car exiting a private property around 6:00 PM.
Police Report and Victim Condition
Senior Sergeant Aldona Naczk, spokesperson for the Kartuzy Police, stated that the driver was likely blinded by the sun and failed to notice the child. The 26-year-old driver was tested for alcohol and found to be sober. The boy, who remained conscious, sustained bruises and was transported to the hospital by helicopter.
Legal Implications of Sun Glare
Police urge drivers to exercise extreme caution, especially near sidewalks and pedestrian crossings, as sunlight can significantly limit visibility. Experts and judicial precedents, such as a ruling from the Bełchatów District Court, indicate that citing sun glare often worsens a driver’s legal position. According to established jurisprudence dating back to 1958, blinding sun does not absolve a driver of responsibility; rather, it dictates a requirement to reduce speed or stop the vehicle.
