Employee Oral Consent for Cash Salary Payment Is Invalid

Polish labor law prohibits employers from paying employees in cash without their written or electronic request.

Basic Salary Payment Rule

Answer: No. Salary is paid to a payment account indicated by the employee, unless they submit – in paper or electronic form – a request for salary payment in cash.

Legal Basis

This rule is established in Article 86, Paragraph 3 of the Polish Labor Code.

Invalidity of Oral Consent

Introducing into employment regulations a provision allowing for such oral consent would be contrary to legal provisions and therefore invalid.

Supreme Court Precedent

The Supreme Court confirmed this in its judgment of September 24, 2003 (case no. I PK 324/02).
