End of refusals in Civil Registry Offices. Changes to regulations open path for same-sex marriage transcriptions

European Court ruling obliges Poland to recognize same-sex marriages legally contracted in other EU countries.

European Court Ruling

The decision comes from a ruling by the Court of Justice of the European Union on November 25, 2025 (case C-713/23).

Legal Obligation

The Court ruled that EU member states must recognize same-sex marriages as legal in the same way as marriages between a woman and a man, if they were legally concluded in another EU country.

Polish Case

The ruling was issued in the case of two Polish citizens who married in Berlin and then unsuccessfully attempted to register their foreign marriage certificate in Poland.
