Expert opinion confirms Mieszko R. was fully insane during the brutal Warsaw University murder, requiring indefinite psychiatric care.
Mental State Determination
Experts have concluded that during the period in question, suspect Mieszko R. completely lacked the capacity to recognize the significance of the actions he is accused of, as well as the ability to control his behavior. Full conditions under Article 31 § 1 of the Criminal Code are met – the suspect’s complete insanity.
Detention Requirements
The suspect’s remaining at liberty with high probability threatens the repetition of prohibited acts of significant social harm, connected with his mental illness – conditions under Article 93b § 1 of the Criminal Code apply. To prevent this, he requires an absolute stay and treatment in a closed psychiatric institution pursuant to Article 93a § 1 pt. 4 of the Criminal Code.
Long-term Supervision Plan
Experts warned that if any grounds arise for releasing the suspect from psychiatric detention, it will be necessary to consider placing him in the National Center for Preventing Dissocial Behaviors as a form of long-term, specialized control and limitation of the risk of repeating a serious crime against life.
Prosecution’s Position
After reviewing the expert opinion, the prosecution sees no grounds to challenge, supplement it, or request another opinion. The case is currently awaiting possible requests from the parties to the proceedings, which, after reviewing the opinion, may file for its supplementation or request another opinion.
Current Legal Status
The preventive measure of temporary detention is still being applied to the suspect.
