Expert Opinion Confirms Full Insanity in Warsaw Murder Case

Expert opinion confirms suspect Mieszek R. was fully insane during the brutal Warsaw University murder, requiring psychiatric detention.

Expert Findings on Suspect’s Mental State

Experts determined that during the period in question, suspect Mieszek R.’s ability to understand the significance of the acts he is accused of, as well as his ability to control his conduct, were completely abolished. The conditions of Article 31 § 1 of the Penal Code are met – the suspect is fully insane.

The suspect’s remaining at liberty with a high probability threatens the repetition by him of an act prohibited by law of significant social harm, associated with his mental illness – the conditions of Article 93b § 1 of the Penal Code are met. To prevent this, he requires an unconditional stay and treatment in a closed psychiatric institution pursuant to Article 93a § 1 pt. 4 of the Penal Code.

Furthermore, experts warned that if circumstances ever arose for the suspect’s release from detention in a psychiatric institution, it would be necessary to consider placing him in the National Center for the Prevention of Dissocial Behavior, as a form of long-term, specialized control and restriction of the risk of recommitting a serious crime against life.

Prosecution’s Response to the Opinion

After reviewing the content of the opinion, the prosecution sees no grounds to contest it, supplement it, or call for another opinion.

Currently, the case is awaiting possible requests from the parties of the proceedings, which after reviewing the opinion may request its supplementation or the seeking of another opinion.

Current Legal Status of the Case

Continuing, a preventive measure in the form of pre-trial detention is being applied against the suspect.
