First Additional Leave for Disabled Employees Calculated Proportionally

Government office confirms initial additional leave for disabled workers is calculated proportionally.

Legal Clarification

The clarification comes from the Office of the Government Plenipotentiary for Disabled Persons (BON) in response to a question from Senator Andrzej Kobiak of the KO party regarding the interpretation of Article 19 of the Act of August 27, 1997.

Entitlement Details

According to Article 19 of the Act on vocational and social rehabilitation and employment of disabled persons (current version: Journal of Laws of 2025, item 913 with amendments), employees with a decision of significant or moderate degree of disability are entitled to 10 additional working days of leave per calendar year.

Acquisition of Right

The right to this additional leave is acquired after completing one year of employment from the date of being classified into one of the specified degrees of disability.
