Former NGO Head Defies Court Order, Faces Legal Consequences

The former head of Miasto Jest Nasze (City Is Ours) is ignoring a court ruling to apologize to Robert Szustkowski for false claims, risking further legal action.

Court Ruling on Defamation

Despite a final ruling from the Warsaw Court of Appeal on February 26, 2026, the former head of Miasto Jest Nasze has failed to issue a required apology to Robert Szustkowski. The deadline of March 12th has passed, and the apology – intended for publication online and in print – has not been delivered.

The “Reprivatization Map” Case

The case centers on a so-called “reprivatization map” published by Miasto Jest Nasze in 2016. The court determined that the information disseminated within the map, suggesting Szustkowski’s involvement in “wild reprivatization” and criminal activity, was false and violated his personal rights.

Continued Dissemination of False Information

Furthermore, available information indicates the former head of MJN continues to repeat the same claims in the media and on social media platforms, despite the court’s decision. The District Court ruling was intended to resolve the dispute, but the conflict may escalate.

Responsibility of Organization Leaders

The case was litigated for years, reaching the Supreme Court, which ruled in 2022 that individuals leading organizations can also be held liable for violating personal rights. Following a re-examination, the court found the former head of MJN (Jan Śpiewak) responsible for his actions.

Legal Consequences of Non-Compliance

Now, concrete legal consequences are possible. Interpretation of the Code of Civil Procedure indicates that failure to comply with a final judgment may result in enforcement proceedings, a court-imposed fine to compel publication of the apology, or an order to pay a monetary sum to the creditor for each day of delay, in addition to standard claims.

Repeating False Claims as New Infringement

Additionally, repeating information already deemed false and infringing on personal rights by the Court can be considered a new violation. Legal counsel Elżbieta Kosińska-Kozak emphasizes that “freedom of speech cannot be used as justification for spreading false information that violates the personal rights of others.”

Potential for Enforcement Action

As no apology has been issued, the case may proceed to the enforcement stage.
