Former NIK Head Marian B. Charged; Prosecutor Issues Statement

On Wednesday, the Białystok prosecutor’s office announced criminal charges against former Najwyższa Izba Kontroli president Marian B. for allegedly inducing officials to disclose tax‑secret information.

Charges Filed Against Former NIK President

The Białystok regional prosecutor’s office announced on 12 November that it would charge former NIK president Marian B. with criminal offenses.

Alleged Bribery and Tax‑Secret Disclosure

The accusation concerns offering incentives to officials of the National Tax Administration to reveal information covered by tax secrecy, an act that may have occurred twice according to prosecutor’s records.

Investigative History Since 2019

Investigations into Marian B. have been ongoing since 2019, having been halted only after reports were filed by the Central Anti‑Corruption Office, the General Inspector of Financial Information, and a group of MPs from the former Civic Coalition.

In 2021, the same inquiry led to the detention of Jakub B., his wife Agnieszka, and former Kraków Tax Office director Tadeusz G., who is Marian B.’s son‑in‑law. They were accused of extorting roughly 120 000 złoty from the National Heritage Fund of Kraków and about 80 000 złoty in VAT, but denied the allegations and provided explanations with financial guarantees.

Possible Sentencing and Prosecutorial Claims

Marian B. faces up to ten years in prison for the alleged inducement to violate tax secrecy and for the convenience of personal or material gain. Investigators contend he also encouraged a public official to exceed or breach duties for personal benefit.

Information Transfer by Tadeusz G.

Tadeusz G. has been charged with repeatedly passing Marian B. information protected by tax secrecy. Evidence shows he intended to disclose data related to tax audits and actions taken by the Central Anti‑Corruption Office against Marian B., an admission he made during the investigation.
