Government Proposes New Rules for Contact with Incapacitated Adults

Polish government submits proposal to regulate contact rules with fully incapacitated adults amid current legal gaps.

Legislative Gap

The Ministry of Justice is preparing changes to regulate contact rules with adults who are completely incapacitated. Information about the project appears in the list of legislative works of the Council of Ministers. Currently, such regulations are missing, which family courts and the Supreme Court have pointed out for years (resolution of May 17, 2018, file no. III CZP 11/18).

Temporary Solution

MS assures that the project will be a temporary solution, in force until the completion of work on regulations abolishing the institution of incapacitation.
