Historic Court Decision on 8-Year-Old Kamil’s Death, But Doubts Remain

Kielce court orders renewed investigation into institutional responsibility for death of 8-year-old Kamil from Częstochowa.

Turning Point in Case

On Thursday (January 15), the District Court in Kielce decided that investigators will once again examine the case of institutional responsibility for the death of Kamil from Częstochowa. This concerns the actions of courts, prosecutors, police and social workers in this case.

“It’s difficult for me to say anything due to emotions. I want to cry with joy. It seems to me that all this is a dream. I am very pleased that the court approached the case so thoroughly and that it will be further investigated. I believe that everything will go in the right direction and that thanks to this case, the entire system will improve,” said Magdalena Mazurek, Kamil’s half-sister, to Wirtualna Polska.

Historic Decision by Children’s Ombudsman

The Children’s Ombudsman also spoke on the matter. She emphasized that this decision is “historic” and “restores the sense of dignity to children who died as a result of experiencing violence, even though there were adults around them.”

“It shows that each of us, and especially institutions, is obliged to react to violence against children. Kamil’s case is fundamental in matters of child protection. It shows what can happen when we do not react. A child can be tortured and die in front of all of Poland. I want to live in a country where children are safe,” emphasized Monika Horna-Cieślak in a conversation with WP.

Doubts Remain and Case Should Be Declassified

The court ruling does not concern the actions of doctors and teachers – in this area, the case is finally settled. “We have doubts about the decision regarding teachers. In this area, Kamil’s sister will probably file a complaint with the European Court of Human Rights. I will support this complaint,” noted the Children’s Ombudsman.

She also added that the case of Kamil from Częstochowa should be declassified. “It would have educational value, what needs to be done to properly protect children,” she said.

The 8-year-old boy was said to have been burned and scalded with boiling water.
