Poland’s KSeF e-invoicing system creates hurdles for buyers as sellers issue pro forma invoices without VAT deduction rights.
Invoice Dispute
A seller claims to have issued a real-time invoice in KSeF but only provides a pro forma invoice to the buyer. This serves as proof of purchase but does not allow the buyer to deduct VAT, placing the tax compliance burden on them.
The seller maintains the invoice was submitted promptly, though buyers cannot verify its status due to ongoing system access issues.
System Access Problems
Theoretically, sellers can issue invoices by the 15th of the following month under standard rules. However, real-time KSeF submissions should allow immediate verification, which is currently impossible.
Since Monday, buyers have been unable to log into KSeF using their Trusted Profiles, blocking access to confirm invoice validity or details.
