Labor Code Now Embraces Electronic Applications

Poland amends Labor Code to officially permit electronic submissions alongside paper forms, resolving long-standing ambiguities.

Legal Confusion Over Formats

Recent amendments address confusion stemming from the Labor Code’s inconsistent terminology regarding application forms. The law previously allowed submissions “in written form,” “in writing,” or “in paper or electronic form,” creating uncertainty about whether emails or HR system entries met legal requirements.

New Regulatory Framework

The revised regulations explicitly permit both paper and electronic formats for numerous labor-related procedures. As noted in the amendment’s justification, introducing electronic options alongside paper forms will streamline communication between employers and employees without negatively impacting evidentiary value.

Implementation Details

The changes are enacted by the Act of December 4, 2025, amending the Labor Code and the Act on the Social Benefits Fund (Journal of Laws of 2026, No. 25). This legislative update modernizes the legal framework to align with practical workplace realities.
