Lawyer Convicted in Fatal Crash Seeks to Avoid Prison

Paweł K., a lawyer sentenced to 18 months for a crash that killed two women, has filed a motion with a Łódź court to halt his imprisonment.

Lawyer’s Appeal for Suspended Sentence

The District Court Spokesman in Łódź, Judge Grzegorz Gała, reported that the defense attorney for Paweł K., who was definitively sentenced on March 5th by the District Court in Olsztyn to one year and six months in prison, submitted a motion to the Łódź District Court to suspend the execution of the sentence.

Simultaneously, a motion was filed by the lawyer’s defense requesting the possibility of serving the sentence under electronic monitoring.

Court Rejects Suspension of Sentence

The Łódź District Court refused to suspend the execution of the sentence, meaning the definitive 18-month prison sentence for Paweł K. will be enforced, stated Judge Gała. The court has not yet made a decision regarding the possibility of serving the sentence under electronic surveillance.

Eligibility for Electronic Monitoring

According to regulations, electronic monitoring can be ordered if the sentence does not exceed one year and six months, and there are no specific reasons indicating that the goals of the sentence would not be achieved.

Requirements for Home Confinement

To benefit from serving a prison sentence outside a correctional facility, the convicted person must have a permanent place of residence, and any adult co-residents must consent to this method of serving the sentence. Technical conditions for monitoring the convicted person must also be met, regarding the number and range of available transmitters and recorders.

Original Sentence and Appeal

The Olsztyn Court reduced the initial sentence. Paweł K. was definitively convicted of causing an accident in which two women died. In April 2025, he was sentenced by the first-instance court to two years imprisonment and a five-year driving ban.

The District Court in Olsztyn reduced the sentence of the first-instance court and sentenced Paweł K. to one year and six months imprisonment and a four-year driving ban.

Details of the Fatal Crash

The accident occurred in September 2021 on the Barczewo-Jeziorany road. According to the indictment, Paweł K., driving a Mercedes, violated traffic safety rules, crossed a double solid line, and entered the opposing lane, causing a collision with an oncoming Audi 80. The driver and passenger of the Audi died at the scene.

Controversial Post-Accident Statement

The fatal accident near Barczewo gained public attention when Paweł K. shortly after recorded and published a video online, stating that the accident was a confrontation between a safe car and a “coffin on wheels,” and that this was why the women died. The statement posted on social media outraged the public.
