Legal Battle Over Rail Baltica Contract: Who Will Build 100km Podlaskie Route?

Court orders review of winning bid in record Polish railway contract amid legal dispute between construction consortiums.

Rail Baltica Project Details

The project involves reconstructing a 100+ km railway section from Białystok to Ełku, which will become part of a high-speed line connecting Warsaw to Baltic states.

Current single-track section allows speeds of 100-120 km/h, but after reconstruction will become a double-track line enabling speeds up to 200 km/h. Level crossings will be replaced with viaducts.

Contract Award and Controversy

In a record-breaking tender with an investor estimate of PLN 6 billion, PKP PLK selected the Polish consortium of Mirbud and Torpol as winner last year.

Their bid of PLN 4.566 billion was significantly below the estimated cost, but the National Appeal Chamber has now ordered PKP PLK to annul the selection process and repeat the evaluation.

Appeal Outcome

The court decision followed a complaint from the second-placed consortium of Budimex and Porr, which claimed errors in the Mirbud-Torpol bid.
