Mother Who Killed Two Children Loses Supreme Court Appeal Against Life Sentence

Polish woman Krystyna S., who murdered her 3-year-old son and 4-year-old daughter in Opole in August 2024, lost her bid to suspend her life sentence during Supreme Court appeal.

The Tragedy in Opole

The tragedy occurred on August 29, 2024, in Czarnowąs, a district of Opole. At that time, 34-year-old Krystyna S. murdered her 3-year-old son and 4-year-old daughter. Her partner and older daughter were not present in the apartment at the time of the incident. Krystyna S. also injured herself, but doctors managed to save her life.

Investigation and Initial Charges

Prosecutors brought double murder charges against Krystyna S. The court ordered her to be remanded in custody. Forensic experts determined that Krystyna S. was mentally competent at the time of the incident. During the investigation, Krystyna S. testified that she had conflicts with her partner and that an argument also occurred during the murders.

“He told me to pack my bags. While he was saying this, he was tearing open trash bags and throwing them at me,” she testified. “I replied that I wouldn’t pack. Then he left. After he left, the children were playing with phones and watching cartoons. I started crying heavily,” she stated. “I didn’t want to hurt them. I don’t know why it happened,” she added.

Court Verdict and Appeals

In December 2024, the District Court in Opole sentenced Krystyna S. to life imprisonment. The court also ordered her to pay 500,000 złoty to the father of the murdered children. In April 2025, the Appellate Court in Wrocław upheld the verdict.

In September, an appeal (kasacja) was filed with the Supreme Court by Krystyna S.’s defense attorney. The date for its consideration has not yet been set.

Supreme Court Decision

The defense attorney, when filing the appeal, also requested a suspension of the verdict’s execution. This would have allowed Krystyna S. to await the Supreme Court’s decision on freedom rather than in prison where she is serving her life sentence.

According to Gazeta.pl, the Supreme Court did not agree to suspend the execution of the verdict. The decision was made in February. In its justification, the court stated: “In case law, there is a well-established position that the institution of suspending the execution of a judgment should be justified by special and unequivocal circumstances leading to the conclusion that the execution of the judgment before the consideration of the cassation appeal would cause exceptionally severe and essentially irreversible consequences for the convicted person.”

“Having conducted a preliminary review of the cassation appeal filed on behalf of Krystyna S., and without prejudging the final resolution of the matter which will take place after the merits of this appeal are considered, the Supreme Court found no grounds to recognize that exceptional circumstances existed in this case justifying the use of this exceptional institution,” the court added.

The justification also states that the defense attorney “did not reveal those special and unequivocal circumstances indicating that the execution of the penalty before the consideration of the filed appeal would cause exceptionally severe and essentially irreversible consequences for the convicted person.”
