On April 5th, a municipal guard officer in Warsaw was found to have nearly 0.36 per mille of alcohol in her system during a routine traffic stop.
Traffic Stop Reveals Impairment
On Sunday, April 5th, around 8:20 AM, a municipal guard vehicle was checked during a police operation called “Sober Morning” on Płochocińska Street.
The officer driving the vehicle was found to have a blood alcohol content of nearly 0.36 per mille.
Legal Consequences of Alcohol Level
This level constitutes being under the influence of alcohol, which is a misdemeanor under Polish law. Police prevented the officer from continuing to drive.
Authorities may also remove the vehicle from the road at the owner’s expense if it cannot be secured otherwise.
License Suspension and Penalties
If there is reasonable suspicion of alcohol consumption, the officer’s driver’s license is temporarily confiscated.
The case will be pursued as a misdemeanor under Article 87 § 1 of the Code of Misdemeanors, carrying a penalty of arrest or a fine of at least 2500 zł (approximately $600 USD) and up to 30,000 zł (approximately $7,200 USD).
Further Actions and Disciplinary Measures
A mandatory driving ban of 6 months to 3 years will also be imposed, along with 15 penalty points on the driver’s record.
Documentation has been prepared, and police will continue investigating the incident. The officer may also face disciplinary action from her employer, separate from the criminal proceedings.
