Polish municipalities risk penalties for failing to protect documented mineral deposits in their local spatial plans.
Mineral Deposits in Local Plans
Municipalities are experiencing problems with incorporating mineral deposits into their local spatial development plans.
Legal Obligation Under Geological and Mining Law
Article 95 of the Act of June 9, 2011 – Geological and Mining Law mandates that municipalities must incorporate necessary changes into their plans to protect documented mineral deposits.
This applies to municipal general plans, local spatial development plans, and regional spatial development plans.
Protected Resources
The law requires protection for documented mineral deposits, carbon dioxide underground storage complexes, and underground tankless substance storage facilities.
