The family of Polish pediatrician Bożena Hager-Małecka is taking legal steps against Netflix, alleging the series “Lead Children” falsely portrays a character inspired by her.
Family Alleges Historical Distortion and Defamation
The family of Professor Bożena Hager-Małecka accuses Netflix of falsifying history in the series “Lead Children” and is pursuing legal action. The dispute centers on the portrayal of a character inspired by the doctor, which relatives claim is inaccurate and damaging to her reputation.
The family has requested Netflix to enter negotiations or mediation, stating they will pursue all necessary legal measures to protect Professor Hager-Małecka’s memory if a “constructive response” is not received, including claims for cessation of infringement, apology, and monetary compensation.
Character’s Depiction and Professor Hager-Małecka’s Role
The series, “Lead Children,” altered the doctor’s name and presented her in a negative light. However, the family’s legal notice asserts that Professor Hager-Małecka played a crucial role in addressing the lead poisoning epidemic in Szopienice.
Professor Hager-Małecka initiated social and systemic actions to combat the epidemic, rather than hindering them, as the series allegedly implies.
First Diagnosis and Systemic Initiatives
The family’s legal representative emphasizes that the doctor was the first to diagnose lead poisoning in the so-called “patient zero” based on tests conducted at her clinic. She also initiated numerous systemic and social initiatives.

Legal Challenge and Demand for Correction
Stanisław Torbus, Professor Hager-Małecka’s grandson, stated that the streaming giant’s attempt to rewrite history left him with no choice but to file a “final pre-trial notice of cessation of infringement of personal rights” against both Netflix Poland and Netflix USA.
He added that dozens of conversations with people who remember the true history of “Lead Children” motivated his decision, and they object to the substitution of facts with fiction.
Legal Arguments and Requested Actions
Legal counsel Krzysztof Breguła points out that despite the name change to Professor Berger, the character clearly references Professor Hager-Małecka. He argues the infringement of personal rights lies in the inaccurate and negative portrayal.
Breguła also notes that Netflix positions the series as a faithful record of historical events in its promotional materials.
The family’s legal team has requested Netflix to immediately display a disclaimer before each episode, stating that the character of Professor Berger does not accurately reflect Professor Hager-Małecka’s role. They also seek a public statement restoring Professor Hager-Małecka’s proper role and financial compensation to be directed to a foundation established in her name.
Foundation to Support Medical Professionals
The foundation will collaborate with the Silesian Medical University and will support the development of young medical professionals through scholarships.
