Poland will introduce new rules for medical leave controls on April 13, including updated authorization forms and protocols for employers and ZUS to verify proper usage.
New Medical Leave Control Rules Effective April 13
On April 13, an amendment to Poland’s Social Insurance System Act will take effect, implementing significant changes to the rules governing medical leave (L4) controls. These controls are conducted by either employers or the Social Insurance Institution (ZUS).
During such controls, authorities verify whether individuals on medical leave are actually working and whether they are using their leave contrary to its intended purpose.
Ministry to Issue New Authorization and Protocol Forms
According to Article 68g of the amended legislation, Poland’s Minister of Family, Labor and Social Policy is required to issue new forms through regulation. These include a new authorization form for conducting medical leave utilization audits and a corresponding control protocol form.
Controllers must present the authorization form to the individual being audited at the beginning of the inspection process. After completion of the audit, they must prepare and submit the protocol form documenting their findings.
