The basis is Article 47c of the Act on Health Care Financed from Public Funds (Journal of Laws 2004, No. 210, item 2135 with subsequent amendments). This provision introduces a catalog of persons entitled to use health services out of turn.

What does this mean in practice? If a person has a referral for spa treatment approved by NFZ, they should be placed on the list with priority according to the law.

Misconceptions About Priority

Significant disability and NFZ sanatorium – who leaves faster and on what basis? Since the law of May 9, 2018, on special solutions supporting persons with significant disabilities, this group has gained real rights to use services out of turn. In practice, this means they have the right to outpatient and specialist services out of turn, and in many NFZ departments, they are also qualified faster for rehabilitation and spa treatments.

“Last Minute” Opportunities

This is not, however, an ‘automatic trip without waiting.’ The NFZ regional department must still approve the referral and match the treatment profile. The right to a service out of turn does not mean we can point to a specific resort and date (e.g., ‘Kolobrzeg in August’). NFZ indicates the location with an available contract.

Waiting Times and Factors

Does priority for NFZ sanatorium apply only to the first trip? There is no provision in Article 47c of the Act limiting this right only to the first spa treatment. Persons with significant disabilities retain the right to services out of turn for each referral – provided the required interval from the previous stay has passed (usually about 18 months) and NFZ approves the referral.
