The Ministry of Justice has unveiled a draft regulation aimed at raising maximum notary fees, with some charges\u2014such as those for drafting wills\u2014slated to rise by up to 300 percent. <\/p>\n
The Government Legislation Center has published a draft regulation proposing significant increases to maximum notary rates. The Ministry of Justice intends to bring fixed fees for non-value-based services into line with current economic realities, according to Aleksander Szyma\u0144ski, president of the National Notarial Council.<\/p>\n
Szyma\u0144ski clarified that the regulation only sets maximum limits. Notaries and clients remain free to negotiate lower fees on an individual basis.<\/p>\n
The most substantial proposed hike affects the cost of drafting a will, which could rise from 50 PLN to 200 PLN, marking a 300 percent increase. Other changes include raising the fee for revoking a will from 30 PLN to 50 PLN, and doubling the cost for processing inheritance declarations from 50 PLN to 100 PLN.<\/p>\n
Power of attorney fees are also set to climb. The maximum rate for a single-act power of attorney will rise from 30 PLN to 100 PLN, while the fee for multi-act authorizations will double from 100 PLN to 200 PLN.<\/p>\n
The ministry proposes raising the maximum notary fee for recording minutes from shareholder meetings of limited liability companies and cooperative assemblies from 750 PLN to 900 PLN. Furthermore, the maximum rate for minutes from shareholder meetings will increase from 1,100 PLN to 1,300 PLN.<\/p>\n
The government intends to revise how fees are calculated for transactions exceeding 2 million PLN. Under the current system, transactions over 2 million PLN are capped at 6,770 PLN plus 0.25 percent of the excess, with a total ceiling of 10,000 PLN, or 7,500 PLN for immediate family members.<\/p>\n
The new proposal sets the rate for transactions between 2 and 5 million PLN at 6,770 PLN plus 0.25 percent of the surplus. For transactions exceeding 5 million PLN, the fee will be 14,270 PLN plus 0.15 percent of the surplus, capped at 25,000 PLN.
