The Polish Ministry of Health, in coordination with the General Counsel to the Republic of Poland and the Ministry of Finance, is preparing an appeal against a Brussels court ruling favoring Pfizer.<\/p>\n
The Ministry of Health intends to challenge a ruling by a Belgian court of first instance that ordered Poland to accept 64 million COVID-19 vaccine doses and pay over 5.5 billion PLN. The dispute stems from a 2021 agreement negotiated by the European Commission on behalf of member states, which Poland stopped honoring in 2022.<\/p>\n
The Belgian court rejected Poland’s arguments, ruling that neither the war in Ukraine nor declining infection rates justified the unilateral termination of contractual obligations. The judgment also found no evidence that Pfizer abused a dominant market position regarding pricing or liability clauses.<\/p>\n
The legal dispute has resulted in the seizure of receivables belonging to the Polish Air Navigation Services Agency (PANSA). On July 1, Eurocontrol informed the agency that its en-route navigation fees were being garnished to satisfy the judgment.<\/p>\n
Prime Minister Donald Tusk announced that the government would provide necessary support to PANSA while continuing to pursue a legal resolution to the broader dispute. The Ministry of Health maintains that a formal appeal is being finalized in strict accordance with trial strategy.<\/p>\n
