These requests can cover both existing operations and planned future collaboration models.

Applicants must provide a detailed description of all relevant circumstances regarding the legal relationship and state their own position on the matter.

Legal Security and Administrative Benefits

The primary advantage for applicants is legal protection. An entrepreneur who truthfully describes the conditions of cooperation and complies with the issued ruling will be shielded from administrative, financial, and penal sanctions within the scope of that ruling.

These interpretations are binding on the National Labor Inspectorate (PIP), granting businesses greater predictability and the ability to operate based on the official stance of the Chief Labor Inspector, provided the actual working conditions match the application description.

Scope and Submission Requirements

Individual rulings apply exclusively to determining whether a relationship constitutes an employment relationship under Article 22 § 1 of the Labor Code. Eligible entities under the 2007 Act on the National Labor Inspectorate may file these requests.

Formal applications must be complete; if there are formal deficiencies or unpaid fees, the applicant has seven days to rectify them, or the application will be left without consideration.

Costs, Timeline, and Limitations

The fee for each individual ruling is 40 PLN per distinct factual state or future event described. The Labor Inspectorate is required to issue these rulings without undue delay, no later than 30 days after receiving a complete application.

Rulings will not be issued if the specific facts or events are already subject to ongoing administrative proceedings by the Labor Inspectorate or the Social Insurance Institution (ZUS).

Transparency and Disclosure

The content of these rulings will be published in the Public Information Bulletin (BIP) after the removal of identifying data related to the applicant and other involved parties.

Starting July 8, 2026, Polish entrepreneurs can request individual rulings from the Chief Labor Inspector to verify if their B2B or service agreements accurately reflect the nature of employment relationships.
