Any group of at least five students aged 13 or older may form a cooperative, provided they secure written parental consent. A teacher-supervisor, appointed by the school head, will oversee documentation, financial management, and daily operations to ensure adult guidance while maintaining student autonomy.<\/p>\n
Cooperatives are not considered business entities under the Entrepreneurs’ Law and do not possess legal personality. They function based on a statute approved by the school head, which defines membership rules, organizational structures, and the scope of activities.<\/p>\n
Membership requires an entry fee not exceeding 10 PLN, which is non-refundable and dedicated to statutory goals. Notably, student work is voluntary and unpaid, and any financial surplus must be reinvested into statutory activities rather than distributed among members.<\/p>\n
Accounting is simplified to maintain transparency without the need for full commercial bookkeeping. Cooperatives must maintain a registry of members and track financial results. If a cooperative fails to meet its requirements or the school ceases operations, its assets are transferred to the school or designated youth-focused public benefit organizations.<\/p>\n
The new regulations take effect on September 1, 2026. Existing school cooperatives active on this date are granted a transition period until September 1, 2027, to align their statutes with the updated legal requirements.<\/p>\n
