The Warsaw Court of Appeal has rejected a request for a safe conduct letter for former RARS head Micha\u0142 Kuczmierowski, who remains in the UK pending extradition proceedings for alleged criminal activity. <\/p>\n
The Warsaw Court of Appeal has upheld the decision of the Warsaw District Court, which previously refused to issue a letter of safe conduct to Micha\u0142 Kuczmierowski, the former head of the Government Agency for Strategic Reserves (RARS). Consequently, the appeal filed by his defense counsel has been dismissed.<\/p>\n
This marks the third time the Court of Appeal has reviewed the challenge regarding the safe conduct request, following the initial refusal by the District Court on September 10 of last year.<\/p>\n
Micha\u0142 Kuczmierowski is currently residing in the United Kingdom. A hearing regarding his extradition is scheduled to take place on September 24.<\/p>\n
Had the former RARS head been granted the safe conduct letter, he would have been protected from arrest upon his return to Poland until the conclusion of the criminal proceedings currently pending against him.<\/p>\n
Kuczmierowski served as president of RARS between 2021 and 2023. In August 2024, the National Prosecutor’s Office announced charges against him and Pawe\u0142 S., the creator of the Red is Bad brand, involving participation in an organized criminal group, dereliction of duties, and exceeding powers for financial gain.<\/p>\n
Prosecutors are investigating whether RARS bypassed public procurement procedures by misusing special regulations under the Act on Strategic Reserves. Investigators allege that specific business entities were granted preferential treatment and that inflated prices were accepted for goods such as power generators and medical supplies. Part of the transaction process reportedly occurred despite formal objections from the Central Anti-Corruption Bureau.<\/p>\n
Kuczmierowski was detained in London in early September 2024 at the request of Polish authorities, facilitated by the post-Brexit agreement between the EU and the UK. While initial bail requests were denied, he was released from Wandsworth prison in February 2025 under strict conditions, including regular reporting to a police station.<\/p>\n
